NOTE: I received several legal documents directly from Rick Stanley, including a PDF file sent by his attorneys, the opinion from the court of appeals.
Because the legal documents are lengthy and difficult to reformat for posting; and because of a notice from the attorneys re possible "privileged information", etc. I have chosen not to post the opinion here.
However, I have included Rick's announcement; a link to where the decision may be read online; and following that some background on the case taken from his website.
I have read the documents. I have been following this case for years; have discussed it with Rick, especially regarding some of the anomalous elements, such as FBI Division 5, Anti-terrorist Task Force and unwarranted harassment directed at Rick Stanley. This is the same type of FBI/DOJ harassment, in some cases, which has been directed at me and by the SAME corrupt feds and their minions/stooges.

OPINION RELEASE: Harrassed by the FBI?
STANLEY NOTE: I have been getting "contacted" by some of these people involved with this situation. Let me say one thing for sure. Barbara Hartwell has been right on the money regarding Tim White, who has been harrassing me after contacting me several years back, befriending me "out of the blue". Other characters keep coming up such as Don Estep, Mark Holstlaw, Steve Olson from the FBI, Joint Terrorism Task Force and who knows what else.
These individuals have also been involved in my cases for years now, always behind the scenes,showing up to interview me in jail, showing up at trials, etc. They keep getting mentioned by more and more as the criminal element of the government in the Denver area.

Other FBI agents have been involved with my cases the past 3 and 1/2 years now. The FBI was instrumental in my arrest on Oct 18, 2003, with the Denver Swat Team being involved as well. To say that the FEDS have been pushing local authorities to charge me with "Influencing a Public Official" would be right on the money.
The FBI initiated my arrest for this charge on that date. The FBI, IRS/CID and US Marshalls were involved in a June 2004 raid upon my business building and personal loft in Denver. Don Estep was involved on that date as well. They were looking for gold, money, paperwork and weapons. They found papers. They stole my wife's .38 pistol from her desk drawer in her office of the business and later we retrieved that from the Thornton Police Department. Notice I said Thornton.
Why were they participating in a raid on my building in Denver? They "stole" my wife's gun (Denver refused to charge anyone for violating the law regarding this issue in their jurisdiction because they protect each other from being charged for violating the law), and did not list it on the search and seizure warrant (theft) because there was "NO WARRANT", no search and seizure authority for guns or weapons. However, they were there looking for and "stealing" weapons. "The truth is".
Why all this? I believe they want to render me without funds to defend myself in court and to destroy my business, which they told all of my employees that they were going to put me out of business and they should all look for new jobs immediately.
All but one left. That employee is still working for the diminished Stanley Fastener and Shop Supply. This is how your government is destroying America and Americans. I have not been charged yet by the FBI or IRS for anything, now ten months later. Nothing has been returned to me either.

There is also a speech I gave to several Denver area Rotary clubs, later re-created for my radio show and taped, and this to is up on the website on the upper right hand side (scroll to the right anout an inch or so to find the link).
Are people in the Patriot movement, whistleblowers, people who are speaking out and standing up for America being targeted? Seems to be the case... I know of hundreds if not thousands.
I know I have. I have been found guilty of filing a pleading in two Adams County courts, of threats to judges although the law clearly says that I have the right to do what I did, regardless of how the government officials involved felt about it. Remember that First Amendment? Free speech? The right to "petition the government for redress of grievance"?
Not in Colorado...I have been sentenced to 6 years in state prison and am out on an $80,000.00 appeal bond or you wouldn't be hearing from me right now. I would be in jail if I couldn't defend myself so far from these criminals. That takes money folks. Lots of it.
All I have ever done is "exercise" my God given, unalienable, Constitutionally protected and guaranteed rights in the POLICE STATE OF AMERICA. Pretty foolish huh?

I am disgusted beyond words. Rick Stanley has been unlawfully convicted of a "crime" simply for exercising his God-given (natural) constitutionally protected and guaranteed rights. Now, his appeal has been denied.
For his courage, his patriotism, his heroism as a Defender of Liberty, Rick Stanley faces a six-year prison sentence.
Meanwhile the REAL criminals --corrupt government officials, law enforcement, FBI, judges et al-- and their minions continue to operate with impunity, here in the Police State of America.

Rick Stanley, Constitutional Activist, former U.S. Senate candidate, Enemy of the State, and self avowed extremist on the order of our forefathers of America, gave the following media release for your use: Rick Stanley was convicted of two charges of "Influencing a Public Official" on Thursday, June 24, 2004. Mr Stanley wished to thank all those who came out to support him throughout the week of the trial.
The GATHERING dinner and subsequent demonstrations in front of the court, the court watchers inside the court room, were all geared to send a message to government, that there are a few Americans who KNOW the fraud, deceit and lies of the government, that has overthrown America and is turning our beloved country into the Police State of America.
It is now known that the birthright and heritage, protected and guaranteed by the Constitution, Bill of Rights and the Declaration of Independence, is over. In America now, the court process cannot be used to file a "Petition for Redress of Grievance", without being concerned that the language used, will not be protected speech. The government contention, that words like arrest, militia, and treason, are in fact threats, defy and boggle the mind. Words on a page no longer mean what they say, but in the minds of the government, will be "construed" and "interpreted" to show that they will make those in government, "feel" threatened.
The government uses the judicial system to destroy American lives each and every day. I have tried to stand up to this "treason" by those in government for their "aiding and abetting those who have an agenda to destroy the Constitution", the rights that are protected and guaranteed therein, and for those who don't even realize there is problem in the government, because the propaganda supplied by the controllers of this country, is so very strong indeed.
Soon, this Patriot to the Constitution of America and the State of Colorado, will be locked away in a state prison somewhere. I will have been silenced by those in government, who are destroying the Constitutions. They will have won another round. The case will be appealed to judge after judge, who are part of the judicial conspiracy to destroy the founding documents with deceit, subterfuge and lies.
Once again, this Patriot has been given another "guilty" for exercising Constitutional rights, because the judge's instructions to the jury, shield them from the truth. That folks, is the crux of the problem. Judges have made rules and regulations to destroy the "Constitutional Judicial System" from the inside.
Common law is now a distant memory. Equity law has replaced another Constitutional guarantee known as a "Common Law Constitutional Court". If you have no Constitutional rights in the courtroom, you have no Constitutional rights on the streets of America. What does that mean to Americans? Your lives are an illusion of freedom and liberty and you are living in slavery. God bless America.

"I paid 102 days in the Adams County Jail for the right of every law abiding American Citizen in Colorado, to openly carry a weapon, anywhere, in any city of Colorado per SB-25, the Colorado State Constitution, and the 2nd Amendment of our national Constitution's Bill of Rights. That's right. I paid for that right with those 102 days in jail in Brighton, Colorado."
June 19th through June 25th, 2004, in Brighton, Colorado, the "GATHERING" of gun activists from across America, will convene to observe the First Amendment violation trial of Rick Stanley, in Brighton at the Adams County Justice Center June 21st to the 25th. Rick Stanley was arrested, thrown in jail for 102 days in Brighton, Adams County, for exercising his constitutional right to openly carry a weapon in Thornton and Denver.
After serving notice to two Adams County judges that his rights were being violated by the jail time, Stanley was arrested for "Influencing a Public Official", because he had filed a pleading to the Courts citing the unconstitutional actions of the judges, advising them that they could be arrested for this illegal action.
Stanley has hired a legal team from two law firms in the Denver area, to defend his First Amendment right to petition the government for redress of grievance. Scott Reisch of the Denver Reisch Law Firm will head the team of lawyers from the law offices of David Calvert in Greenwood Village. Brett Davies and John Fuller from Calvert's firm will complete the legal team.
The group from www.stanley2002.org have decided to converge on Adams County for the "GATHERING," to support Rick Stanley in his upcoming trial. Outraged that Stanley is charged with a potential 12 to 32 year prison sentence, for the two felony charges of "Influencing a Public Official", the group organized the event to bring attention to the injustice of Stanley's arrest, jail time and new charges.
When told of the "GATHERING", Stanley said, "Fill em up. Fill those holsters with lawful weapons of choice. I paid 102 days in jail for that right, and I urge every American to lawfully exercise the right to openly carry a weapon in Brighton, Colorado during the "GATHERING." While Stanley is out of jail on a $25,000 bond and unable to possess a weapon because of the special conditions imposed by the court, Stanley will wear an empty holster throughout the trial, but urges the "GATHERING" to "Fill em up" per the state constitution, SB-25 and our 2nd Amendment rights.
Mr. Stanley went on to say, "I hope every law abiding gun owning citizen will come to this event in Brighton, Adams County, to show judges of this country that our right to keep and bear arms and our First Amendment right to petition the government for redress of grievances are "fundamental" rights not to be granted to Americans as "privileges", by judges operating outside the boundaries established in the Constitution under the fraud of "color of law." This event will establish once and for all, that Americans will not tolerate "judicial activism" or the "Police State of America."
