NOTE: To my regular readers, this report may not be of interest to you, as it is in regard to personal legal issues. But this website is the only venue I have, or use to publish material, whatever the reasons may be. Boring as I'm sure it is, just skip it. I hope to have more interesting subjects coming up soon.
FOR THE RECORD
The purpose of this report is to create a public record and direct it to the attention of officials in the town of Rhinebeck, all of whom have jurisdiction over the area where I live, and some of whom have been contacted in reference to these issues.
The Rhinebeck Police. The State Police. The Housing Department. The Health Department (including Water). The Zoning Board. Dog Control.
This is a tale of two utterly unscrupulous individuals, who, separately, and in tandem, have perpetrated a number of egregious and injurious injustices against others, in particular, Barbara Hartwell. That would be me.
They (individually and in collusion) are also violating various codes and ordinances in the town of Rhinebeck. See below for details.
One of these individuals is the landlord (or should I say, slumlord) of a number of rental properties on a parcel of land in Rhinebeck, NY, namely one Kirk Rotger of New Millennium Realty. The other is his tenant, one Tracy Krawitt aka “Spacey Tracy”, proprietor of Spacey Tracy's Deep Fried Pickles, a commercial business she runs on the property, thus violating the zoning laws.
This is a classic slumlord story. Those reading this, who have had the bad fortune of dealing with a slumlord, will anticipate where this story is headed. But I have my reasons for documenting this debacle publicly. Mainly, it is about justice. Justice I don't expect to see, because I am a poor person who can't afford a lawyer, and because justice is for sale, to those who can afford to pay. But then, those people would not be living where I live, as they are more likely to own their own property.
For the most part, nobody cares for the poor. We fall through the cracks and are treated with disrespect, simply because we are considered the lowest of the low, having no money. And because they think they are safe from the consequences of their abhorrent actions, as we have no resources to pursue justice under the law.
The exceptions are pro bono lawyers for the poor, elderly and disabled, who are limited in their practice to the minimum assistance, to stopping unlawful evictions and other such abuses by landlords, but are not able to advocate for anything more. Still, I am grateful for those who have helped me, who have provided advice for me to deal with the injustices I face by ill treatment and offenses from the slumlord.
Nonetheless, I still care about justice and I want the gross injustices exposed. If that is the only satisfaction I can get, so be it. As well, I am a journalist, who has a venue (unlike many others victimized by such a slumlord), so I will use what I have to expose wrongdoers, even if only to warn others.
And because for various reasons (including the aforementioned poverty) I cannot afford to move, not for the foreseeable future. And I don't intend to allow the landlord (or any hostile tenant) to drive me out of my home. I know my rights, I know the law and I am documenting the facts for my own protection.
In January, 2014, I entered into a contract for a rental on this property, in Rhinebeck, NY, where I still reside today. This is a one room cottage, located on a small plot of land, with an area in front for parking, a small strip of land I have turned into a garden, as well as a backyard.
It is located on a piece of land where there are several such cottages, in a complex owned by the same landlord (slumlord).
There is a common circular driveway, but aside from that the rental properties have separate, private yards.
When I first met with a representative of the landlord to view the property, I asked a number of questions to determine if the property would meet my requirements.
First and foremost, I require a freestanding building (no matter how small), as I will not live in an apartment where other people have access to the building or yard. Privacy and security are my main concerns.
It must be in a rural setting, strictly residential, where the zoning laws prohibit commercial enterprises, which also disturb the peace and privacy of tenants.
I require privacy and an environment which allows for my lawful right to “quiet enjoyment” of the property. Meaning, no source of noise, disturbances, or other intrusions preventing me from having peace in my home.
I clearly and specifically explained my requirements to the landlord's representative when I first viewed the property. I explained that I am a disabled senior citizen, so I am unable to do heavy labor (yard work) and that I cannot afford to hire out for help.
My stated requirements were as follows:
Exclusive private access to the rental property and surrounding yard (front and back). Meaning no common access from other tenants.
Basic maintenance of the property and yard provided, specifically that the grass be mowed and the property cleared of weeds. And I wanted the option of making a garden and other landscaping, which I would tend myself.
That any visits to my rental property by the landlord or his employees (for repairs or other necessary issues) be by appointment only, at a mutually convenient time, agreed upon in advance by both parties, with a minimum 24 hour notice. No unannounced visits for any reason.
I was assured by the representative that these requirements, being standard procedure and reasonable, would all be met. In good faith, expecting the landlord to keep his part of the contractual agreement, I signed the lease.
However, I soon learned that any idea of “good faith” was a false expectation; that the landlord was a liar, as was his representative who showed the property to me. Not only was he a liar, but a greedy slumlord, who cared nothing for the needs of his tenants, nor had any respect for their privacy, or even their fundamental rights, not only as tenants, but as human beings.
As it turned out, every legal right I have as a tenant has been violated. I have been denied the quiet enjoyment of the rental property for which I am paying. And what I am paying far exceeds the value of the rental, all things considered.
In January, 2014 the rent was $575.00 per month. For a one room shack with bad plumbing, bad water, a leaking roof, inadequate heat, and in need of various other repairs, inside and out.
The rent has now more than doubled. He is charging $1250.00 a month. And I am attempting to survive on disability, which is the paltry sum of less than $12,000.00 a year. That does not even cover the rent.
(I know my own poverty is not the issue, and I can't blame the slumlord for that. But he is well aware of my situation, and continues to raise the rent, in efforts to price me out.)
Many of the necessary repairs still have not been made (after all this time) and in desperation, I have had to hire workers out of my own pocket.
In some cases, the landlord's workers were so sloppy and incompetent that they actually did damage to the walls and floors, while making other “repairs”. The damages were never acknowledged, nor rectified.
This is the highest rent I have ever paid anywhere in my life, for the smallest place I have ever lived, totally lacking in any but the most primitive amenities. I rented a 4 bedroom beach house in Maine for less than I am paying now.
Simply as a result of my reasonable efforts to make my home habitable, by making complaints of unacceptable conditions, I have been harassed, threatened with eviction (for which there are no grounds); I have been publicly slandered and insulted; I have been falsely accused of offenses I did not commit. I have had my sanity impugned. I have been treated with a total lack of respect by the landlord, his office workers and his hirelings, and my privacy has been regularly invaded.
I have been traumatized by this horrible treatment, and my health has suffered from the extreme stress, which I have been warned about by my doctors. I have medical conditions which are exacerbated by stress, which I need to avoid at all costs. The landlord's office has been notified of this, in writing, after I suffered one particularly stressful, traumatic episode of the landlord creating a public scene, while banging on my door, threatening, harassing and slandering me. I had to visit the emergency room later that day, as a result of a medical episode.
I have lived in unacceptable conditions, for years on end, even with health hazards, due to the landlord's failure to make necessary repairs and renovations, even after he was cited for violations by town officials.
I have documentation for all of this. In addition to phone calls, I have made formal complaints in writing, sent to the landlord's office, since January, 2014 when I first moved here. It's all on the record, I have left nothing to chance. No one can prove otherwise.
And before I go further, I will state for the record that never once have I violated any laws, nor broken any agreements in the lease, nor caused any disturbances on this property. I have paid the rent on time, with no exceptions. I have always been quiet and respectful of other tenants. There is no just cause for the execrable way I have been treated, and no excuse whatsoever.
Now, add to this that a criminal tenant, Tracy Krawitt, who moved to the property (I believe in 2018) has created a hostile environment, is violating numerous codes and ordinances and has harassed me by making false complaints to the landlord. The woman is a pathological liar and appears to be a psychopath, with no respect whatsoever for the privacy, personal boundaries and fundamental rights of others, specifically, in this case, her neighbors.
I say she is a criminal for at least one criminal offense that I know of: She made a false police report against Barbara Hartwell, lying to the police that I had “threatened to kill” her, in December, 2019. Making a false police report is a crime in and of itself. Details of the event of the false police report are documented in reports, links below.
Krawitt is also running a commercial business on the property, which violates the zoning laws. She has a huge food trailer and attached truck parked in front of her house, a garish monstrosity, an eyesore, along with other commercial paraphernalia, tables, plastic drop cloths, metal stands, gas tanks and other trash which litters the road in front of her house. The side of the ugly trailer, showing images of what appear to be the flames of Hell rising from the base, faces the main road, which ruins the rural setting and makes the whole place look like the site of a shantytown for itinerant carnival workers.
Krawitt has a number of commercial vehicles, including trucks, which she parks in the common driveway (just a narrow dirt road), cutting off access to other tenants, which we have the right to use, and which she has no right to do. Other vehicles (including trucks), owned by her associates/employees, come in and out at all hours. Making a racket, creating gridlock and blocking the road. All violating the zoning laws and disturbing the peace on the property.
Huge, noisy commercial delivery trailer trucks also come in to the property, while men wheel the deliveries to her house on carts. US Foods is one such company. The drivers are loud and rude and have blocked the driveway on a regular basis, stopping me from pulling my car out to the main road.
This was a quiet residential area, as it was meant to be, until Krawitt invaded with her multiple commercial vehicles, all her piles of trash and noise pollution, and she is violating the laws by running this commercial business. She is depriving other tenants of the right to quiet enjoyment of their rental property. And the landlord is allowing it, so he is also responsible for what goes on, as he owns the property. He does nothing to stop her, despite complaints from other tenants.
But the violations don't end there. Krawitt is the owner of a large, aggressive, out-of-control dog, violating the laws as a dog owner. She allows the dog to run free, unleashed, on the property and the roads, thus creating a safety risk for other tenants, animals, pedestrians and motorists, and for the dog himself. She has neglected the dog and left him home alone, to be hanging out an open window, howling and barking, disturbing the peace. I had to make repeated complaints to Dog Control to stop her from causing daily, hours-long disturbances by the howling dog.
She has been cited for violations several times by Dog Control, but has failed to take any action to comply with the leash laws. To this day, the dog is running loose over the property. Looking out the window as I write this, I see him, and hear him...barking at her associates, also low class loudmouths, a constant invasive presence on the property. There are now 5 vehicles blocking the driveway.
The dog has invaded my rental property numerous times and has run in front of my car while I was driving, forcing me to slam the brakes to avoid hitting him. How dangerous is this!
Krawitt has regularly invaded my property as well, chasing the unleashed dog, and when confronted to “get the hell out of my yard”, has cursed at me and called me a “psycho”. Which is exactly a description of her, considering her outrageous behavior. I mean, you can't make this stuff up.....
I do not know this woman and have never spoken to her, nor do I engage her in any way in discussions or arguments, despite her offenses and provocations. My policy is to ignore her, document her offenses (see reports on this site) and when necessary, report her offenses to authorities. The one exception is to say: Get the hell out of my yard, when she and her dog invade my rental property. In fact, in most cases, I have ignored her rather than engage in a confrontation.

But back to the slumlord, and let me start from the beginning. When I moved into the rental property in January, 2014, it was quiet and peaceful. There was a beautiful stream (a creek), which flowed through my backyard. The stream was one of the reasons I wanted the property, as I love moving water. At that time, I met the neighbors in the cottage next-door, who were friendly and quiet. They still live there, and I have always been on good terms with them.
[NOTE: The stream has now been destroyed. The slumlord had his workers come into my yard, chop down a lovely old tree, covered in vines, and just threw all the branches and the huge trunk into the water, clogging it up with refuse and changing the course of the stream. It's mostly now a dry bed, which I can't see, nor can I hear the sound of the rushing water at night. What a crying shame to destroy such a once-peaceful natural setting. But then, he doesn't care, he doesn't have to live here. And by the way, where the old tree once stood, he erected what appears to be a metal cell tower-type receptor or some such electronic device. Adding more electronic pollution right in my own yard. Horrible!]
But by the time the spring came around, I knew I had some serious problems.
It started with the weeds. When I say “weeds”, I don't mean the garden variety. These were huge stalks, rising to over 6 feet tall. They covered the backyard and actually grew so close to the house that they blocked all light from the windows in the kitchen area (a small galley at the back of the room) and adjacent bathroom. The weeds were literally pressing up against the windows, blocking the air flow. But that didn't stop the insects (including horseflies and wasps) from invading through the ripped screens. Which I finally had to replace myself, at my own expense, as my complaints were, as usual, ignored.
I called the landlord's office to report the problems caused by the overgrowth of weeds. The office workers said they would send someone to take care of it. But nobody ever showed up. Time went by. Week after week, I kept calling. I sent letters by certified mail.
Meanwhile, the weeds continued to grow. I was suffering from allergies and from the stifling lack of air inside the cottage. I was unable to use the backyard, there was no space left.
I continued to call the office. The office workers continued to assure me that the problem would be taken care of. But, as usual, they lied. Nobody ever showed up, and no explanation was given.
July, August, September, October, came and went. Finally, in sheer frustration and desperation, in November, I called the Town Hall in Rhinebeck, attempting to get some relief. I reported the situation with the weeds, and a town official from the Housing Department came to make an inspection.
As can be imagined, he was shocked and horrified. The man stood there, shaking his head (Oh, this is terrible, terrible...) at the back of my cottage, viewing the field of stalks, now dried and brown, but leaning against and totally blocking my windows, an eyesore as well as a health and fire hazard.
He contacted the slumlord, citing him for violations of the housing code and notifying him that he must immediately rectify the situation.
But now, things only got worse for me. The slumlord, finally forced to take action, sent some workers to cut down the stalks. But instead of cleaning up the dead stalks, they just left them in a pile against the side of the house, to rot there in the yard. I was forced to hire someone myself to clear the dead foliage from my yard. The entire summer had passed, I had no use of my own yard, and now the winter had come.
No apology was ever issued. No compensation for the stress and health hazards to me. And even worse, the slumlord blamed me for the problem. When I had called to report the pile of trash left in the yard, he shouted at me, claiming, That is your responsibility!, when in fact he had always been responsible for maintaining the property, as per the lease agreement.
When I protested that I had done nothing wrong, nothing to cause the problem, that it was not my fault, he shouted at me, You called the town! As if this were a heinous crime, to call the town for relief because of his negligence! Truly unbelievable.
No, I was expected to live in filthy, unsafe, inhabitable conditions, rather than take action to rectify the situation.
Then, there were the workers he hired. Most did not even speak English. And the slumlord would just send them out, at his own convenience, in violation of his agreement with me to arrange a mutually convenient time when I could expect them. Which was not only the agreement, but is my right as a tenant.
They would come banging on my door, expecting to be let in, with no concern for my privacy. I would not let them in, or I would just ignore them.
On my door I have a NOTICE posted:
NO TRESPASSING
NO SOLICITING
SERVICE VISITS BY APPOINTMENT ONLY
I had notified the slumlord years ago that I require, and that I have the right, to a minimum 24 hours notice if a worker needs to come to my home. He is well aware of this policy, but has repeatedly disregarded it, with no respect whatsoever for my rights as a tenant.
I ignored the knocking. The workers were tramping around outside my house and then came knocking and shouting again. I ignored them.
Don't they speak English? Well...no, unfortunately they don't, and I guess they can't read English either.
I once again had to call the Health Department, for yet another issue with the plumbing. The Health Department came, investigated and made a diagnosis regarding the situation.
They made it very clear that there was a major overhaul needed and also cited the slumlord (once again) for the health code violation, which involved a major problem with the sewage and water system.
The Health official told me that he had explained all this in detail to the slumlord. He also told me that there was no need for anyone to come inside my house: the issues were all outside. So, why send his workers to come knocking at my door? Aside from the total lack of respect for my privacy and my rights, there was no good reason to do so.
I am a tenant, not a plumber or contractor. It is not my responsibility to discuss the problems with his hired help (who do not speak English), especially since they do not need access to my house. The slumlord was told exactly what the problem is. If he failed to take action to rectify his violations, that's on him, not me.
But of course, I am the one (as always) who suffers the consequences of his negligence, total lack of respect and callous disregard for his tenants.
In one instance, when I called the office to complain about this unacceptable behavior, I was actually told by the woman that, He has million dollar properties, and they take precedence, so I would have to wait until they could fit me in to the schedule. Maybe when hell freezes over.
Unbelievable. Imagine the level of arrogance, and the unmitigated stupidity of the woman delivering this message.
Then, there is the fact that I am not on speaking terms with the slumlord. Not since October, 2023, when he staged a horrible disruption and public scene outside my home, when he showed up unannounced, with a crew of his workers, in total disregard for my policy, and demanded to be let in, which I did not allow.
He was banging on my door, making threats to evict me – for which he has no grounds. He was harassing me, making demands to be let in. He was publicly slandering me, so all the neighbors could hear, and making false accusations against me, based only on false complaints by another tenant, one Tracy Krawitt, a criminal offender who had made a false police report in December, 2019, lying to the police that I had “threatened to kill” her.
And the slumlord actually went across the road, marching straight to her door, after falsely accusing me of “harassing” the other tenants (none of whom I know, nor had ever even spoken to), which was a total fabrication by Krawitt, threatening that these tenants (including Krawitt) would back him up against me.
Next, I was expecting him to recruit a mob, with torches and pitchforks, a veritable witch hunt!
These false accusations by Krawitt, then repeated at me by the slumlord, had absolutely no basis in fact, and was apparently an attempted intimidation tactic, which he was foolish enough to believe would work on me. And I do have witnesses to his threats and harassment. If there were an actual legal issue (which there was not), the only way he could have dealt with it is using the law. But it is on record, documented and he cannot deny his false accusations without lying. But then, that's never been a problem for him. Just like his pal, Krawitt.
In fact, Krawitt, the odious liar, had been making false complaints to the landlord's office, claiming the devil knows what, and he apparently believed her.
He also grossly insulted me and impugned my sanity, accusing that there were “mental health issues” because I refused to open my door for an unannounced service call. Absolutely outrageous!
Never in my life had I witnessed such totally insane and aggressive behavior from any landlord, nor had I ever encountered any neighbor as crazy and evil as Tracy Krawitt.
I have lived with substandard conditions for the entire time I have had this rental. Including "health hazards", as cited by the Health Department.
Now, about the water. It is water from a well on the property. The water is so dirty it often comes out of the tap brown, at times even black. It stinks like sulphur from the bowels of hell. Not only that, but on a regular basis, the water would just shut off and the tenants would be without water for hours, sometimes days.
As it turned out, the landlord had been violating the codes by not installing a proper water system. The plumbing was so bad, you never knew if there would be enough pressure to take a shower, even to flush the toilets. Everyone that I knew of suffered from this unacceptable situation.
The problems in my house were particularly bad. Plus, the fixtures in the bathroom were nonfunctional, crusted with mineral deposits. I had to use buckets of water to flush the toilet. I had reported this to the office in 2022, saying I needed immediate action, for major repairs to be made.
I was told by the morons in the office that a “work order” had been put out for the repairs. Of course, nobody got back to me. Time passed, as the problems became worse and worse. Again, I called, I wrote certified letters, made detailed formal complaints. Only false promises, more suffering for me, no action taken.
When calling the office, as usual, got no results, I finally also called the town, the Health Department. An officer came to do an inspection and take my formal complaint.
He, like the officer from the Housing department, years ago, was shocked at the condition of my bathroom. He inspected outside and found that there was no pipe system at all. The water from the bathroom sink and shower, and the kitchen sink, was just draining into the ground outside the house, and then going into the stream (what was left of it) polluting the area.
I don't know all the gory details, but suffice to say it was a total mess, and the slumlord was cited for numerous violations of the health code, and forced to do major renovations, inside and outside.
The officer from the Health Department actually thanked me. He said if not for my complaints and my persistence in documenting the issues, they never would have known about the deplorable conditions on the property, and the “health hazards” (their words) to tenants, including me.
From the beginning of this ordeal, all officials from the town have been respectful and supportive of me; they knew my complaints to be justified, and even thanked me for issuing the complaints, so the major problems with the property could be rectified, not just for me, but for other tenants.
Next item: The backyard excavations. Early on, I was experiencing serious issues with the plumbing. The landlord did not know where the septic tank was located, on his own property. He sent a crew of workers with a bulldozer (or a backhoe) to dig up my yard, littering it with rocks and debris, which he just left there. (As usual, I later had to hire someone to clear out the rocks and clean up the mess.)
The septic tank was finally located, right behind the house. A septic service was called, to pump the septic tank. When the man came to the door, he actually said to me, something about the “slumlord”, as if it was a known fact. Evidently, he was notorious in the area.
After the septic tank was pumped, the slumlord's workers just left the metal cover (which had been covered with soil and grass) to sit there, without covering it back up. Again, I had to hire someone to clean up the yard, shovel the dirt back and plant grass.
Of course, there is much more to this saga...it never ends...
There is no rest for the weary.
But enough for now.
And I will end with this:
With all due respect: Town Officials of Rhinebeck, please take note.
People who own property, who become landlords, need to at least abide by the laws and the codes and the ordinances of the town where their property is located. Tenants have rights, whether they are rich or even the poorest of the poor – people like me, who are ill treated and deprived of the right to quiet enjoyment of the rental property for which they are paying. (In my case, an exorbitant sum.)
Tenants also have the right (as part of quiet enjoyment) to not be disturbed by violations of other tenants, such as howling dogs, running unleashed on the property and in the road, causing safety hazards; or commercial businesses operating unlawfully in a residential zone, disturbing the peace, preventing them from the use of a common driveway, and the noise pollution of huge delivery trucks, shouting workers, horns blasting.
The eyesores of trailers and piles of trash, meant for an industrial setting, not in what should be a quiet residential family neighborhood. We also have the right not to have our property invaded by a negligent dog owner, a lying criminal who makes false police reports, cursing at us when she is warned to stop her invasions and harassment.
This aberrant and injurious behavior is truly outrageous! Somebody needs to do something about it. Sooner, rather than later.
I was told by a town official that I could make a formal complaint against Tracy Krawitt to the town by filling out a form. I haven't done that yet. I have other pressing issues to deal with that take precedence over this.
But I am issuing a public warning to Tracy Krawitt, whom I consider a public menace, here and now:
Stay off my rental property and keep your unleashed dog out of my yard, the road where I am driving or walking. Stay away from me, and any guests I may have, who have been accosted in the past.
I can't stop this woman from making false complaints, nor from continuing to slander me. But if she ever invades my private yard again (for which I am paying rent for the exclusive use), I will call the police and let them deal with it. Enough already!
For now, this is my report for the public record.
But I need to make it clear that I have sustained tremendous damages, financially, and to my health, by the invasions of privacy, the stress and trauma, the public slander (including to the police) and intentional infliction of emotional distress by these individuals, one of whom is a known criminal.
I am seeking justice and will continue to pursue it, even if that means only exposing these people in my reports, and using any and all lawful and ethical means at my disposal.
Unlike my adversaries, the slumlord and his criminal tenant, I am a law-abiding citizen, seeking only peace and the quiet enjoyment of my home.
