FORMAL COMPLAINT AGAINST TENANT TRACY KRAWITT TO LANDLORD OF RHINEBECK PROPERTY

 

 

The following is an excerpt from a letter to my landlord, sent certified return receipt, after tenant Tracy Krawitt made a false complaint to the landlord against Barbara Hartwell.

 

I want this on the public record, for my own protection, because, given the past pattern of behavior, it would be reasonable to conclude that the offender, one Tracy Krawitt, is likely to fabricate additional lies and false accusations against Barbara Hartwell.

Krawitt has no ground (legal or otherwise) to stand on; no evidence to support her injurious false accusations. The damages to me are mounting, including emotional distress and the necessity of spending my valuable time and resources in self defense against this onslaught of injustices.

My purpose is to put a stop to the offenses of this aggressor by any and all lawful and ethical means available to me. Should there be further offenses, they will be documented and reported to the appropriate authorities.

EXCERPT:

I was told that the “complaints” from “other tenants” were that I was accused of being on the parcel of property (yard) rented by Tracy Krawitt. No other “tenants” were named, so if there were more than one, I was not informed of it. Otherwise, the complaints, as outlined to me, were non-specific and vague.

Here are the facts, for the record.

By a number of incidents, Tracy Krawitt has shown herself to be a malicious liar. The most recent false accusation against me was that I was on the property outside her house (yard.) That is an absolute falsehood. At no time have I ever walked in close proximity to her house.

On February 15, I made a call to Dog Control, to make yet another complaint against Krawitt for noise disturbance caused by her howling dog, only the most recent of such complaints.

Krawitt has been repeatedly cited by Dog Control for violating regulations. Clearly, she has continued to disregard and violate the regulations, causing the peace to be disturbed by the noise.

I was standing in the common driveway to make the call because the Dog Control officer asked me to call from outside so that she could have evidence of the howling, hearing it herself. I never left the driveway while on the phone with Dog Control and was at least 25 feet from Krawitt's house.

While I was standing in the common driveway, a woman came up behind me in a car, parked in front of Krawitt's house, jumped out and came running down the driveway. She aggressively accosted me, shouting at me and asking if I was “on the phone with the warden”. I ignored her, though she continued to harass me until I walked away, never having spoken a word to her.

It was none of her business who I was talking to, nor was it her business that I was standing in the common driveway on a rental property for which I am paying. I do not know who this woman is, I had never seen her before. But whether or not she is a tenant, she was the sole offender, for accosting and harassing me.

In reference to Krawitt and her accomplice (the unknown woman), at no time have I said or done anything on this property which would warrant any sort of complaint against me, by anyone.

Tracy Krawitt has made a number of false accusations against me, beginning in December 2019, when she made a false police report (which is a criminal offense), claiming that I had “threatened to kill” her. This was a bold-faced lie! This, after she caused a huge disturbance outside my house with her commercial vehicles, coming within inches of hitting my car, and in fact invaded my yard, where she had no right to be. Her associate (the driver of the truck) was cursing and verbally assaulting me with obscenities in a menacing manner.

In my own defense, I have documented the many offenses of Tracy Krawitt and have published reports exposing her offenses against me, including this latest. These reports are on the public record, posted on various websites, including my own.

I will not tolerate being slandered by this woman, with false accusations being made against me. Please be advised that I have now been inappropriately cited by your office for an offense I did not commit, based on the testimony of a malicious liar (or liars, as the case may be.)

At no time have I ever set foot in the yards of any other tenants, unless by invitation, or with permission. This certainly includes Krawitt, whom I do not know, with whom I am not on speaking terms, and with whom I have no dealings whatsoever, and never will.

As for her many offenses, I deal with them by exposing them for the public record and reporting them to civil authorities.

I have the right to the reasonable expectation that I will not be treated with any bias whatsoever, simply because of the false accusations of this malicious liar, Tracy Krawitt.

Let this serve as my formal written complaint against your tenant, Tracy Krawitt.

Just as I predicted in my last report, and in another before that, Tracy Krawitt has resorted to lying again, this time in making false accusations against Barbara Hartwell to the landlord who owns and manages the property.

Following a complaint I made against Tracy Krawitt to Dog Control on February 15, 2023, on February 16, I received a call from a representative of my landlord's office letting me know that “other tenants” (who were not named) had made complaints against me. I told the associate that I knew the complaint had to come from Tracy Krawitt, and that it was absolutely false. She admitted to me that Krawitt was involved, but no other names were given.

When I asked the nature of the complaint, I was told that I had been accused of being on the property rented by Tracy Krawitt. Another absolute lie from Krawitt & accomplices.

The way the property is set up, each cottage has a separate, clearly designated yard as part of the rental. The tenants are free to use these separate yards as they see fit, to have a garden, or place lawn ornaments, furniture, etc.

There is a common driveway (the only common area) around which the cottages are situated, the front of each facing the driveway.

At the time of the incident of February 15, when I made a complaint to Dog Control about the howling of Krawitt's dog, I went outside to phone the Dog Control officer, as she had asked me to do. The fact of the matter is this: The entire time I was standing in the common driveway, at least 25 feet from Krawitt's house. At no time did I leave the driveway, nor set foot in the yard.

Since Krawitt was not on the property at the time of this incident, it is clear that the liar who was responsible for making the false report to the landlord was the aggressive woman (name unknown) who accosted and harassed me in the driveway, whom I never spoke to, but ignored. I do not know if this woman is a tenant on the property, only that she is a liar and an accomplice of Krawitt. Until that day I had never seen her before.

The person I spoke to from the landlord's office was given false information from one or more liars (including Krawitt). I tried to explain the facts of the matter, but was told that I was being informed that I needed to “stay on my side” of the property.

I explained that I had never, at any time, walked into another tenant's yard uninvited, including Krawitt. I have never, at any time, been anywhere near her house.

I am well within my rights, as a tenant on this property, to access the common driveway, as is every tenant. Which is exactly what I did, and no more, in an attempt to provide the requested evidence to the Dog Control officer of the howling dog, disturbing the peace on the property.

I have now been falsely accused by the landlord's office, based only on a false report from a known liar, Tracy Krawitt and at least one accomplice. I will not allow that false accusation to stand. The landlord's office should be apprised that if any action whatsoever is taken against me, based on the false accusations of Tracy Krawitt and accomplices, I will pursue legal action in defense of my rights (including, but not limited to, as a tenant).

In point of fact, Krawitt, a tenant on the property, has been the only aggressor, the only offender, against Barbara Hartwell, on multiple occasions.

That I, as the injured party, have suffered various damages, since 2019, as a result of Krawitt's harassment, false witness, false police reports, slander and defamation of my good name to various parties (to date the police and the landlord), and disturbances on the property, for which she is solely responsible and for which she will be held liable.

Furthermore, the landlord is responsible for the quality of the environment on the property which provides the tenants their right to quiet enjoyment of the rental property for which they are paying.

Tracy Krawitt has repeatedly disrupted that environment and turned it into a loud, ugly, hostile place. She has certainly prevented me personally from the quiet enjoyment to which I am entitled.

Even though it is a rental property, it is also my home, for more than 9 years. I have invested time, effort and money in my home. And I will defend my rights against any and all who would violate them.

I intend to pursue every lawful and ethical means available to me to expose this malicious liar, Tracy Krawitt, to hold her accountable for her offenses, and to see justice served.

NOTE: This is the third report I have found it necessary to publish, exposing the offenses of one Tracy Krawitt, who regularly creates disturbances on the rental property where I have been a tenant since 2014.

Krawitt is running a commercial enterprise out of a residential property not zoned for commercial purposes. There are large vans and trucks parked on the property and blocking what is supposed to be a common circular driveway on the property, thus stopping other tenants from the use of the driveway. These vehicles are also eyesores, ruining the natural setting of the property.

Krawitt is the irresponsible owner of a neglected dog, who howls and barks non-stop when left unattended, a disturbance to anyone whose activities are interrupted by the noise. I have personally been stopped from sleeping, from speaking on the telephone, from conducting radio interviews, as a result of this disturbance.

Here is the latest update, which I have also added to a previous report (link given below).

UPDATE

For a few months after I made complaints to Dog Control, the barking and howling stopped. Apparently, Krawitt was directed that she was required to put a stop to the noise disturbances or certain consequences would follow.

But then, as time passed, the howling started up again. As before, the dog would be left alone, unattended, and would hang out an open window.

One night in February, 2023 at 10:30 PM, the howling started and kept up until 11:15 PM, which made sleep impossible. I called Dog Control the next day to report the disturbance.

I was told that I should document each incident in future as to time and date. And that I should call the cell phone number of the officer so that she could hear the howling herself over the phone. I agreed that I would do that.

On February 15 at 4:10 PM the howling began. I went outside and saw that the dog was once again hanging out the open window at Krawitt's residence. I called the Dog Control officer to report the incident. She acknowledged that she heard the howling, and asked if I could take a photo of the dog, and I told her I did not have the equipment to take a photo.

As I was standing in the common driveway speaking to the officer, a small white car came up from behind me, going way too fast, and parked in front of Krawitt's house. A woman jumped out, came running toward me and accosted me, as I was standing there talking to the officer. She yelled at me, “Are you on the phone with the warden?”. I ignored her and did not respond. She then continued to harass me, attempting to aggressively interrogate me.

I ignored her and walked away. I never spoke one word to this offender. The howling stopped when the woman entered the house.

When I got back to my house, I called the officer back to report the incident of the harassment by the unknown woman, an associate of Krawitt's.

The officer told me that she could not do anything about the harassment of the woman, but only about the dog. I explained to her that I was well aware of that, and that I only wanted to make certain the incident was documented, in case I was falsely accused of something by Krawitt's associate, just as I had been falsely accused and slandered by Krawitt, who lied to the police and made a false report in 2019, claiming that I had “threatened to kill” her.

I explained that I do not engage in discussions or arguments with strangers who accost me and harass me. And I refuse to have any dealings with Krawitt or anyone associated with her in any way.

And I hereby state for the record that any further approaches by any associates of Krawitt will be regarded as harassment and will be reported as such to the police.

I will continue to document every incident, every offense, involving this reprehensible liar, Tracy Krawitt, and/or her associates.

I will not allow these unscrupulous individuals to continue to create disturbances which disrupt my quiet enjoyment of the rental property for which I am paying.  Not on my watch.
